Nailbiz.co.uk has endeavoured to make the descriptions (including all images) of the Products as accurate as possible but we cannot be held responsible for changes in Size, Content or Presentation of Products made by the relevant manufacturer.

Because of the nature of the Internet Nailbiz.co.uk provides and maintains Nailbiz.co.uk on an "as is", "as available" basis and makes no promise that use of Nailbiz.co.uk will be uninterrupted or entirely error free. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

Nailbiz.co.uk will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communication outages, fire, flood, war or act of God.

These Terms do not affect your Statutory Rights as a consumer.

Please note that not all products sold on Nailbiz.co.uk are suitable for use outside of the UK. If you access either website from outside the United Kingdom, you are responsible for compliance with local laws.

Nailbiz.co.uk may change or withdraw any part of Nailbiz.co.uk, or may refuse you access to the web site at any time if we consider it necessary.

Nailbiz.co.uk may also terminate this Agreement and immediately remove, cancel or suspend access to and use of Nailbiz.co.uk upon breach of any part of these Terms whatsoever.

Termination shall be without prejudice to Nailbiz.co.uk's other rights.

Nailbiz.co.uk acts as a principal on its own account and not as an agent for you or any other person.

If Nailbiz.co.uk does not enforce any provision of this agreement such will not be considered a continuing waiver.

In the event that any part of these Terms is held to be unenforceable, such part will at Nailbiz.co.uk's option be construed as far as possible to reflect the parties' intentions and the remainder of the provisions will remain in full force and effect.

These Terms constitute the full agreement between you and Nailbiz.co.uk and may only be amended in writing. They apply to the exclusion of all other Terms or Conditions of contract proposed.

Use of Nailbiz.co.uk and these Terms are subject to English Law and the jurisdiction of English Courts.

Availability

The Website is only intended for use by people resident in the United Kingdom. Nailbiz.co.uk does not accept orders from individuals outside the United Kingdom.

Nailbiz.co.uk may suspend the Website for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades, and shall not be liable to you for any such suspension.

Nailbiz.co.uk reserves the right to make any changes to the Website or to discontinue any aspect or feature of the Website without notice.

In the event that Nailbiz.co.uk, in its sole discretion, considers that you are making any illegal and/or unauthorised use of the Website, and/or your use of the Website is in breach of these Terms, Nailbiz.co.uk reserves the right to take any action that it deems necessary, including terminating without notice your use of the Website and, in the case of illegal use, instigating legal proceedings.

Returns
We do accept goods back at Nailbiz.co.uk on the basis that the goods have been un-opened and unused and are in a re-saleable condition. By this we mean that all packaging and or cellophane wrapping and tamper resistant seals must be intact. If the packaging is damaged/opened the item cannot be re-sold and we will not be accepted by our Returns Dept.

We will refund the value of the goods upon receipt of them or exchange them if requested.

When returning items to us please ensure that you include a brief explanatory note which must include your name, order Number and the reason for the return.

*Please note that all orders must be returned to us within 30 days of purchase.

Nails at Work bookings

Your Status

By placing an order to purchase Products (Order) through the Website, you warrant that:

You are legally capable of entering into binding contracts; and

You are at least 18 years old; and

You are resident in the United Kingdom.

Prices

The price of any Products will be as quoted on the Website from time to time, except in cases of obvious error.

These prices exclude delivery costs. Any delivery costs will be added to the total amount due as set out in the delivery options offered.

Prices are liable to change at any time, but changes will not affect orders in respect of which you have already been sent a Dispatch Confirmation.

The Website contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on the Website may be incorrectly priced. Nailbiz.co.uk will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, Nailbiz.co.uk will charge the lower amount when dispatching the Product to you. If a Product's correct price is higher than the price stated on the Website, Nailbiz.co.uk will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your Order and notify you of such rejection.

Nailbiz.co.uk is under no obligation to provide the Product to you at the incorrect (lower) price, even after a Dispatch Confirmation has been sent to you, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

You agree that we may use Personal information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
